Motion to dismiss in same sex marriage suit denied

The mood was almost festive when New Paltz, New York mayor Jason West was defying the state’s law by performing so-called marriages for homosexuals. West, a green party member, performed 25 of the phony ceremonies on Feb. 27th of this year saying it was the best tine he had spent as mayor. However the 26 year-old mayor is in a more serious frame of mind now that his motion to dismiss a civil suit brought against him by a member of the town’s board of trustees has been denied. While West had argued that Trustee Robert Hebel had no standing to bring the suit against him Judge E. Michael Kavanagh said, “If this court were to adopt the mayor’s strict interpretation regarding standing, his actions, which on the surface to appear to be in direct contradiction of state law, would be left unchallenged in any civil forum.”
